Really they are not.  Not in Coeur d’Alene, Idaho. The Mayor does not think so and neither does her cohort group of thieves – the LCDC (Lake City Development Corporation) think so.

Tom Hasslinger with the CDAPress  tells us that those “Big Ticket” items are getting prepped to go. “Namely, a redone McEuen Field in downtown Coeur d’Alene and a revamped education corridor near the North Idaho College campus.”

“That’s what we’ve been saving for,” said Tony Berns, LCDC executive director. “The board has been wise to leverage a lot of our resources by borrowing money when money was cheap, so we’re in a good position to tap into that cash to most likely help pay for some of these big-ticket items.”

The key word is “help,” that’s why property taxes are going up. Wayne Hoffman with Idaho Freedom reports,  Spending, tax increases are not ‘conservative’ budgets  “In Coeur d’Alene, the city is contemplating a 1.5 percent increase in property taxes. “We’re asking the citizens an awful lot, but this is the best balance we can come up with,” said Mayor Sandi Bloem, according to a story in the Coeur  d’Alene Press.”

Unbelievable. Some benefit. Homes in foreclosure, real estate at rock bottom, jobs are scarce, our governments are taking madatory furloughs and the city plans to RAISE TAXES so they can pay for those “big ticket” luxury items that will enhance their vision. They need eye exams, badly. I also have a feather for them and a place they can stick it so CDA gets sufficient public attention.

After a long battle, Brannon got Kootenai County to open up the ballots for a review. Last Friday, an affidavit filed by one of Brannon’s supporters documents more apparent problems. Bill McCrory took pictures of absentee ballots and says he found 877 ‘anomalies’. Everything ranging from a lack of signatures to people signing ballots that were not theirs. Brannon’s attorney says there are enough problems to alter the results of the election.

This Friday at 3:00 PM a hearing will be held before Judge Hosack regarding Jim Brannon vs. City of Coeur d’Alene, etal. – CV-2009-0010010. This hearing will be held at the Kootenai County Courthouse in Coeur d’Alene, Idaho, 451 Government Way.  There are two court areas, the new courtrooms and the old courthouse. Since no courthouse or courtroom as been assigned, you will have to ask or check the dockets.

The hearing on Friday is not going to be just any old hearing. In the context of the election contest it is huge. What occurs there, good or bad, will have a dramatic effect on the suit.

Let’s give Judge Hosack a sea of faces to view. Standing room only, and beyond, can only help.  This is what might happen.

• The City will be brought back in and Kennedy’s motion to dismiss will be denied.
• Bill and Lisa McCrory’s  motion to intervene, despite Kennedy’s objection, will be granted.
• If the City is not brought back in we may be looking at a permissive appeal, that Judge Hosack might grant.  However, you would think that Judge Hosack would want to avoid a permissive appeal because this would only drag the case out longer and longer.

Jim Brannon needs our support and so does Bill and Lisa. Keep in mind that Kennedy has the benefit of
almost unlimited time on CDA TV 19 to get his perspective across.  I caught a portion of the city council meeting last week. The city council was very biased in their perspective in assuming that their voices represent all of the people in the City of Coeur d’Alene when they discussed this lawsuit and the “slim” chances available to Mr. Brannon. Let’s remind them that Mike Kennedy retained his position with the City of Coeur d’Alene with only a 5 vote lead that is under dispute.

If you want to see your judiciary work for you to ensure a fair elections process in Kootenai County, you are urged to attend. However, the courtroom has not been assigned yet.  You may have to ask or check the docket when you arrive.

Let Judge Hosack see someone other than the Mayor, City Council, Dan English, and the cast of characters from City Hall and the County Prosecutor’s office!

The Lake City Development Corporation is expressing concerns about their online documents or any documents being altered. I caught their last meeting on cable yesterday. Susie Snedaker of Coeur d’Alene, Idaho attended this meeting and asked for clarification in regards to her request for public records. The records she asked for were disclosed along with a statement that requested she not alter them or distribute them in an altered form. What exactly does that mean? This was a concern of hers so she approached the LCDC and they apologized and did not have issues with her personally, that she would actually alter the documents. Susie Snedaker reminded the LCDC that public records are just that - public records. Altering a public or private document to deceive is a crime as well as altering confidential records – it’s called fraud.

Maybe the LCDC is worried that phony records will surface because their documents are not secured? Securing them online would be prudent and would relieve the threat of tampering as well as give the public the transparency they are requesting. It appears that the LCDC is considering doing this, but it looks like it may be at least 3 months out.

It was mentioned in one of my posts that an URA can basically can get drunk on taxpayer’s money because there is no oversight. Mind you, I was not the one who actually said it, I quoted it.

Well, I know it’s petty, it’s ridiculous, and it’s years old but, I wonder what did the LCDC spend $182.25 of our money on at Crickets, downtown steakhouse and bar – owned by the Vice Chairman of the LCDC – Jim Elder!

We can only wonder.

In Coeur d’Alene, Idaho the latest development concerning CV-2009-0010010, Jim Brannon vs. City of Coeur d’Alene etal., Judge Simpson has voluntarily disqualified himself. Jim Brannon allegedly lost by 5 votes and now has pressed the lawsuit to examine the votes. The lawsuit is heated and is ripping the very seams out of the community.

There are known ties to an alleged fraudulent vote that stems from Judge Simpson’s wife’s commercial business address and there is speculation into the conflicts that are seemingly apparent because his wife has also been appointed to and works within Idaho Supreme Court Committees, alongside of the Judicial Council. This is a clear cut example of how nepotism muddies the judicial waters. Any hint of impropriety is reason for the judge to disqualify himself in order to retain the trust of the people.

Additionally, Idaho Supreme Court Justice Burdick is running for reelection and sits on the same committee, the Wellness Committee, with Judge Simpson’s wife, which has oversight over all of the judges in Idaho. Spouses on these committees who sit as members with our Supreme Court Justices is an ethical conflict – at least in my eyes.

I am not certain why Judge Simpson actually disqualified himself, but I am glad he did, and it was the right move. I just wish he had done this earlier in the lawsuit.

Many of the votes questioned happen to be linked to influential citizens in /from this area.  Ironically, some of these citizens are also linked to the questionable winner of the race, Mike Kennedy.

The CDAPress article spotlights names of relatives who are related to the county commissioner and to folks who gave the defendant a place to live so he could questionably say he was a resident of Coeur d’Alene in order to run legally. That voter happens to vote from Canada along with some others who don’t live in the area any longer.

What the article failed to mention is that one of  the voters, voted from a commercial address that happens to be a commercial address of the judge’s wife. Judge Simpson is the presiding judge over this lawsuit, CV-09-10010. They must be saving that juicy morsel for later fodder. Many of the alleged fraudulent voters will also not return calls. Looks like a subpoena may be the only thing they will understand – that they won’t sign or acknowledge unless they want to live in Canada – FOREVER – and no coming back to Coeur d’Alene, Idaho!

What is absolutely uncanny is how our local and state government is supporting the right to vote here locally, through people who are residents of another country, specifically Canada. According to the CDAPress Staff Writer, Tom Hasslinger:

They’re at most allowed to vote in presidential and statewide elections, Kelso argued, but not city elections since a chapter in state code dealing with municipal elections classifies legal voters as residents who have lived at their primary abode for 30 days prior to the election- the same rule the lawyer argues should disqualify Ainsworth’s and White’s votes.

But Reed, supported in opinion by the Secretary of State’s Office, said the state requirement makes the votes legal. As with the federal and state voting requirements, citizens abroad can maintain their voting rights so long as they don’t register to vote in their new countries, and maintain a local address.

However, there is still questionable speculation concerning the legitimacy of the addresses. They did not live there in other words.  These questions will all be eliminated when voters will be required to produce valid ID this next fall.

Coeur d’Alene Press staff writer, Tom Hasslinger also tells us: 

During the mayoral and council election, 6,370 city votes were cast. Confidential Investigations said the firm’s dug up around 10 ballots out of the first 20 or so they’ve looked into – with up to 90 more ballots possibly on the way – that the judge should toss out, including White’s.

We also have a problem with incorrect information being given. From the CDAPress comments by Dan English, Kootenai County Clerk:

The only clarification I would add, and this goes to your post at 7:29 straight up, is that the written instructions to register Sgt. Major Proft at the courthouse address came from the Secretary of State’s Office and even had the name of the staff member included. They have since clarified that was in error but we did follow their directions.

According to the defendant and the county clerk, these discrepancies are considered “innocent mistakes”, not to mention those who have given misleading addresses. However, it appears that Idaho only requires an “address,” you just can’t use the courthouse address.

If I ran into Judge Simpson’s car, Dan English’s car, the Mayor’s car, or for that matter anyone else’s car and nailed it, accidental of course, then should that act be considered an innocent mistake? Or, would I be held liable?

I am absolutely aghast that the defendants and our Secretary of State actually believe it is legal for those people who do not live here, can vote in city elections.

So, if I live in both Coeur d’Alene, Idaho and Spokane, Washington (addresses in both areas) – then I can vote in both city elections? Here is the link to the requirements of Spokane,Washinton. According to Idaho, if I keep my local CDA address but move to Spokane, Washington, I can still vote in the CDA city elections. Right? Then if I move from Spokane, Washington to Canada, I can vote in both CDA and Spokane city elections from Canada, right? Then, if I move from Canada to Mexico, I can still vote in Coeur d’Alene and Spokane. Right? If I have relatives in Post Falls and I lived with them for 30 days and I have a PO address, I can vote there too! I just can’t vote in Canada or Mexico unless I register there as a voter. Right?

I was reading where one of the admendments that will be argued to slow or even stop the health care legislation signed into law by our President will be to make sure that we don’t foot the bill for Viagra and abortion drugs to an  undesireable population. It’s strategy. By opposing the admendment, the opposition is saying they are in favor of paying for this controversial medication.  I don’t quite understand the fraudulent payments to dead people. Isn’t that already illegal?

“This amendment would enact recommendations from the Government Accountability Office to stop fraudulent payments for prescription drugs prescribed by dead providers or, to dead patients. This amendment also prohibits coverage of Viagra and other ED medications to convicted child molesters, rapists, and sex offenders, and prohibits coverage of abortion drugs.”

It would also prevent people like this from ever getting the prescription. But, think about it – what Idaho doctor would prescribe it? I mean – really – that would happen in Idaho?

“”It was our intent, [...]]]> In view of the fact that our Idaho Legislature is putting off urban renewal changes until next year, local activist, Dan Gookin, has made an impact and the CDA Press has now published the check register of the Lake City Development Corporation.  Mike Patrick, Managing Editor for the CDA Press tells us:

“”It was our intent, since LCDC wasn’t sharing this info with the public, we would,” Patrick said. He added that The Press will be requesting similar records from other public entities.”" Mike Patrick purchased the records after speaking with Dan Gookin.

“Urban renewal agencies are intended to trigger economic development but can operate without oversight from voters or citizens in raising funds for projects, ” according to Brad Iverson Long – Idaho Reporter.

House panel delays urban renewal changes until next year.

 Bob Schaefer, R-Nampa, who said he’ll introduce legislation to do away with urban renewal next year.  He said urban renewal agencies are basically spending other people’s money.  “We’ve got this money scheme out there where you’re taking it from legitimate taxing entities.  That’s not the right way of doing things … This is like going to an Urban Renewal bar and getting drunk and doing things you wouldn’t do if you had your senses about you,”  Schaefer said.
